The development required substantial excavation for the construction of a vehicular access to an under croft. Under the Act, these works required notification be served upon the neighbouring property owners.
The affected property, Regency Hall, is a residential development of 21 flats. Party Structure and Adjacent Excavation notices were served on the freeholder and seven of the affected leasehold property owners. The majority of owners responded by dissenting to the works and appointed their own surveyor.
All relevant areas were inspected by both surveyors to establish the current condition. A Schedule of Condition was subsequently created for each property and an Award containing an overview of the proposed works and the schedule of condition was agreed and published to each owner.
